New Jersey DUI/DWI Information
In New Jersey, it is illegal to drive while under the influence of drugs and/or alcohol. It is also illegal to operate a motor vehicle with a blood alcohol concentration (BAC) of 0.08% or higher. If a person drives while impaired by drugs and/or alcohol, and/or has a BAC of 0.08% or higher, he/she can be charged with driving under the influence (DUI/DWI) or driving while intoxicated (DWI).
DUI/DWI law is very strict in the state of New Jersey. Once a person has been arrested for
DUI/DWI, he/she faces multiple legal penalties if convicted. A DUI/DWI conviction can lead to the following non-enhanced legal punishments:
DUI/DWI First Offense
- $250 to $400 monetary fine
- maximum of 30 days imprisonment
- 6 months to 1 year driver’s license suspension
- possible vehicle interlock device
DUI/DWI Second Offense
- $500 to $1,000 monetary fine
- 48 to 90 days imprisonment
- up to 2 years driver’s license suspension
- possible vehicle interlock device
- 30 days community service
DUI/DWI Third Offense
- $1,000 monetary fine
- 180 days imprisonment
- up to 10 years driver’s license suspension
- possible vehicle interlock device
- up to 90 days community service
New Jersey Breath Alcohol Test
When you drive on the roads of New Jersey, you are automatically giving your consent to submit to a breath alcohol test should you be stopped for DUI/DWI by law enforcement. According to New Jersey law, “Any person who operates a motor vehicle on any public road, street or highway or quasi-public area in this State shall be deemed to have given his/her consent to the taking of samples of his/her breath for the purpose of making chemical tests to determine the content of alcohol in his blood.”
If you refuse to submit to the breath alcohol test, you can be fined $250 to $500. Additionally, your driver’s license will be suspended for up to 6 months for your first offense, and up to 2 years for your second offense.
